Filing Trademark Application: 

1. A Power of Attorney notarized and duly legalized up to the Iraqi Consulate.

2. The name, address, nationality and occupation of the applicant.

3. Ten prints of the trademark; the Arabic transliteration must be shown above the Latin script.

4. The classes and sub-classes of goods to be covered by the application. The wording of the list of goods to be protected must conform to the local classification.

Filing Patent Application:

1. A power of attorney notarized and duly legalized up to the Iraqi Consulate. If your clients cannot legalize it up to the Iraqi Consulate, kindly try to legalize it up to the Jordanian Consulate and we shall complete the legalization in Jordan at the cost of US$ 250.00

2. Legalized deed of assignment from the inventor to the applicant.

3. The name, address, nationality and occupation of the applicant.

4. One copy of a summary of the invention in English with the Arabic translation.

5. One copy of the specifications and claims of the invention in English with the Arabic translation (8 copies of specifications & drawings are required we can prepare the remaining 7 copies at our end at the cost of US$25 for each set).

6. One set of the drawings, if any.

Note: The Iraqi Registrar of Patents may ask for a legalized copy of the corresponding foreign basic registration of the proposed patent.

Filing Design Application:

1. A power of attorney duly legalized up to the Consulate of Iraq.

2. The name, address, nationality and occupation of the applicant .

3. One copy of a short description of the design.

4. One copy of drawings or reproductions of the design.

5. Two miniature models of the design.

Filing Copyright Application:

There is no copyright filing or registration in Iraq at present.

• What is the term of protection for marks?
  - 10 years as from the year 2004

• Can one application cover more than one class?
  - Yes, without any limitation

• Does Iraq adopt the international classification?
  - Yes, but is implemented in addition a local classification classifying each class to subclasses.

•  What sort of publication is implemented?
  - Each accepted application has to be published 3 times in the official gazette, if no opposition against it, its registration certificate will be issued after the laps of 3 months from the last publication.

• Is it possible to claim priority?
  - Yes.

• Is it possible to renew the registration after the laps of protection period?
  - It could be renewed within one month after the end of its term, this one month can be extended by a request to the Registrar.

• Is It possible to assign any trademark registration with or without its goodwill?
  - Yes.

• Does the patent application be examined?
  - Yes, but after the completion of filing all relative documents.

• Is it possible to file incomplete application?
  - Yes, but it should be filed within 6 months from the filing date.

• What about the duration of protection for patents?
  - 20 Years.

• Is it possible to file or designate Iraq for PCT application?
  - No. Iraq, is not a member state of PCT.

• Is it possible to file designs, and how long the protection period?
  - Yes, it is seven years renewable yearly.
