Filing Trademark Application: 

1. A Power of Attorney duly legalized up to the Kuwaiti Consulate.

2. A legalized copy of the mark's Home Registration Certificate or a legalized copy of a

4. Twelve prints of the mark not exceeding 5 X 5 cms; additional charges are to be paid for large size prints.

Filing Patent Application:

1. A Power of Attorney duly legalized up to the Kuwaiti Consulate.

2. An Extract of the Entry of the Applicant in the Commercial Register or an official copy of the Memorandum or Articles of Association, if the Applicant is a company or a body corporate (legalized up to the Kuwaiti Consulate).

3. A Certificate of Incorporation legalized up to the Kuwaiti Consulate.

4. The title of the invention.

5. A summary description of the invention in English and its Arabic translation.

6. The number and date of the corresponding foreign patent.

7. The name, address, nationality and occupation of the Applicant(s) and inventor(s).

8. Two copies of the specifications of the invention in English, together with their Arabic translations.

9. Two sets of the formal drawings of each language bearing any reference numerals or words, and prepared on Bristol paper.

10. A Deed of Assignment document from the inventor(s) to the Applicant(s) legalized up to the Kuwaiti Consulate.

Filing Design Application:

1. A power of attorney legalized up to the Consulate of Kuwait.

2. An extract of the entry of the applicant in the commercial register or an official copy of the memorandum or articles of association, if the applicant is a company or body corporate legalized up to the Kuwait Consulate.

3. The name, address, nationality and occupation of the applicant.

4. Two representations of each design or model should showing the various views. The figure of the design or model should be placed in an upright position on the sheet. When more than one figure of the design or model are shown, these should be on the same sheet, each designated as "perspective view", "side view" or as the case may be.

Filing Copyright Application:

1. A legalized power of attorney up to the Kuwaiti Consulate.

2. Two copies of the work

Copyright registration is administered by Kuwait National Library which has prescribed forms for different types of copyrights. This form should be filled in and submitted to the Library with the material to be registered.

Trademarks

• What is the term of protection of a trademark?
  - Protection period is 10 years, calculated from the filing date.

• Can an application be filed without its complete documents?
  - No.

• Are there any goods or services for which the mark can not be registered?
  - Beer, ale and porter in class 32, alcoholic goods in class 33 and pork meat in class 29 are not registrable.

• Can one application cover more than one class of goods/services?
  - A separate application is needed for each class.

• May priority be claimed?
  - Priority claim is not applicable as Kuwait is not a member of Paris Convention.

• Can the trademark application be opposed and what is the opposition period?
  - Trademark application can be opposed within 30 days from the date of 3rd publication.
